DATED : 10th OCTOBER, 2022 P.C:- The learned counsel for the applicant rely upon the order dated 22/9/2022 passed in case of co-accused Paresh Kasar, who was released on bail in the event of arrest, since the role attributed to him in the subject C.R, is that of a receiver who received the stolen property, Section 41 was not invoked. The learned APP do not dispute that the role assigned to the present applicant is also identical and therefore, the said order would even govern him.

In the wake of the said statement, the applicant deserve his release on bail. Hence, the following order :- Tilak

O R D E R

(a) In the event of his arrest, the Applicant - Sachin Kamlakar Thakare in connection with C.R.No.391/2021 registered with Padgha Police Station shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.

(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer. The Applicant should not tamper with evidence.

(c) The applicant shall report to the Investigating Officer on 17th and 18th October 2022 and thereafter as and when required.

(e) In case of failure to respond, the protection in favour of the applicant shall stand automatically recalled and the Police Officer will be at liberty to arrest him.
