Heard the learned counsel for the applicant, intervener and the learned APP for the State.

This is an application for restoration of Anticipatory Bail Application No. 28 of 2023 which came to be dismissed for default in appearance of the applicants.

The learned counsel for the applicants submits that after the application came to be dismissed, applicant No. 1 Vipul Shah came to be arrested and has since been released on bail. 4.

For the reasons assigned in the application and to advance the cause of substantive justice, the order dated 25th August, 2023 dismissing the application for want of prosecution stands set aside qua the applicant No. 2 Murari Shah only.
