At the outset learned APP submitted that investigation in the present crime is completed and charge sheet is ready to be filed in the Court of competent jurisdiction. However, in view of Order dated 13th October 2022 it could not be filed till today. She on instructions submitted that Investigating Officer will submit charge sheet within a period of one week from today. The said statement is accepted.

In view of the above, learned Advocate for Petitioners seeks leave to withdraw present Petition with liberty to file an application MANISH SURESH THATTE MANISH SURESH THATTE Date: 2023.04.05 10:02:53 +0530 for discharge and/or to contest said case arising out of C.R No.I-733 of 2021 registered with Park Site Police Station, Mumbai, as contemplated under the provisions of Cr.P.C before the Trial Court.
