This is an application for early hearing of Criminal Appeal No.793 of 2013 arising out of the offences punishable under the Prevention of Corruption Act, 1988. Heard the learned advocate appearing for the applicant / accused. The learned advocate, on instructions, submitted that wife of the applicant / accused is unable to move avk 1/2

35-APPA-1247-2016.doc and is suffering from ailment of severe arthritis. He further argued that on merit, the applicant / accused has good case. The applicant / accused is already released on bail by suspending his sentence. Jail appeals of the year 2010 are pending before this court.

In this view of the matter, out of turn hearing to the appellants who are on bail cannot be granted. Hence, the application is disposed of with a direction that the appeal be listed for final hearing as per its turn in its category.
