This Application is filed by the Applicant, apprehending arrest, on the basis of the communication dated 15 July 2021 and 16 July 2021 issued by the Senior PI of Economic Offences Wing (EOW), Raigad Alibaug. These two notices are issued on account of investigation into complaint dated 3 July 2021 lodged by one Ashok Shantilal Bafna. However, admittedly no formal FIR has yet been registered against the Applicant.

37-aba-2898-2021 for anticipatory bail has been simply disposed of observing that "the complaint is filed".

I have heard the learned counsel for the parties. 4.

In my considered view, the Criminal Application can be disposed of by directing the Investigating Officer to give clear three working days notice to the Applicant, in the event the offence is registered and the Investigating Officer proposes to arrest the Applicant. Ordered accordingly. Subject to this, the Criminal Application is disposed of. This order be communicated to the EOW, Alibaug Raigad.
