Heard learned Counsel for the parties.

This application if for bringing legal heirs of deceased Respondent No.8.

Office note shows that all legal heirs of Respondent No.8 are duly served. In spite of that no one appeared on behalf of them when the matter called out.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

a) Civil Application is allowed in terms of prayer clauses (a) & (b) which reads thus:

"a) Delay in filing present Civil Application may please be condoned;

b) heirs and legal representatives of the deceased Respondent No.8 as mentioned in the cause title of the present Civil Application may please be permitted to be brought on record, by setting aside the abatement and further permitting the Applicants to carry out consequential amendments"

b) Amendment to be carried out within six weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

c) Civil application stands disposed off accordingly.
