By an order dated 28.9.2017 the applicant was granted interim relief and was directed to attend the Investigating officer on stipulated dates.

The learned APP. on instructions from the Investigating Officer submitted that the applicant did not comply with condition No.(ii) imposed upon him by earlier Order dated 28.9.2017 and attended the Investigating Officer as per his own whims and fancies and as a matter of fact on two occasions he attended the Investigating Officer after 2.00 p.m. and also did not join the process of investigation.

On 11.10.2017, the learned counsel for the applicant had sought time to take instructions from his client in that behalf. Today the learned counsel appearing for the applicant fairly conceded the submissions made by the APP. Thus, it appears that the applicant has scant respect for the Orders passed by this Court and is taking undue advantage of the interim protection granted to him.

In view thereof, the interim relief granted by Order dated 28.9.2017 is hereby vacated.

As a consequence thereof the present application is also dismissed.
