In furtherance of deliberation which took place on earlier occasion i.e. on 8th December 2022, learned APP has produced on record opinions given by experts in the field of Forensic Science attached to Sassoon General Hospital, Pune. It is stated in the opinion that death of deceased is possible due to suicide due to pressure mounted around neck by self locking nylon zip. That, the same can happen even without there being fracture to the bone of neck.

The evidence collected by investigating agency till today, shows that death of Kapil Vitkar is most probably by suicide only. The record of investigation indicates that, the concerned

2 of 2 31.WP.4260.2022.doc Investigating Officer has recorded statements of various persons who are employed in the said company i.e. TCS, at Pune. It prima facie appears to us that the Petitioner is changing his stance and every time is making further allegations against some or the other persons. 3.

After perusal of entire record of investigation we find that, the investigation has been carried out in proper manner. According to us, transfer of investigation to any other independent investigating agency at least at this stage is not necessary. 4.

The petition is accordingly disposed off.
