Pursuant to order dated 04/07/2019 passed by this Court, the learned counsel for respondent no. 2 has tendered a communication addressed to the learned counsel thereby undertaking that the land to the extent of 1Hector 80R Gat No. 103 old Survey No. 139 will not be alienated till the decision in the Suit Nos. 161 of 2009 and 182 of 2018 pending on the file of Civil Judge Junior Division Vadgaon

2 910.2150.19 wp.doc Maval. Petitioner nos. 2 & 5 are also present in the Court and also undertake that they will not create 3rd party interest in respect of the land in question.

In the aforesaid background, petition stands disposed of with directions that both aforesaid Civil Suits be tried together. It is made clear that findings recorded by the Authorities in the orders impugned will not come in the way of parties to claim their respective rights over the land in question in the Civil Suit.
