Heard the learned Counsel for the parties.

The Petitioner is seeking a direction to the Respondent-IDBI Bank to consider the Petitioner's candidature on compassionate ground. The Petitioner is a wife of deceased employee. According to the Petitioner, preference under the policy to the Petitioner would be first preference and therefore there is no question of seeking no objection of other relatives.

k 2/2 9 wp 975.23 as.doc The learned Counsel for Respondent No.1-IDBI Bank at the outset raises a preliminary objection that the Respondent No.1Bank is not amenable to writ jurisdiction, and even if it was so amenable the appointments on compassionate basis within an establishment are structured by the internal policies. The Petitioner has already applied and the learned Counsel for the Respondent Bank states that as per the policy, decision would be taken after all compliances are made. That being the position, we dispose of the Writ Petition.

We have no doubt that the Respondent Bank would consider the position sympathetically and take necessary decision. The learned Counsel for the Respondent Bank states that this sentiment expressed by the Court will be brought to the notice of the concerned Director. SANDEEP V. MARNE, J.
