This is an application for bail in C.R. No. 724 of 2019 registered with Chakan Police Station, Pune for offences punishable under Section 3, 4, 5, 6 & 7 of Immoral of Traffic (Prevention) Act 1956.

The applicant was arrested on 23rd April, 2019. The prosecution case is that, on 22nd April, 2019 police received information from informant that prostitution activities are conducted at hotel Kunal. Trap was led and dummy customer was sent. The police raided the premises. The applicant and two women allegedly indulging in prostitution activities were found in the premises. On completing investigation, charge-sheet is filed.

Learned counsel for the applicant submitted that the applicant is working in the premises whereas alleged activities were conducted. The applicant is in custody from the date of his arrest. Charge-sheet is filed. The victims were major. The victims have no made allegations of exploitation against the applicant. 4.

Learned APP submits that the applicant was found in the premises at the time of raid. The prosecution case is that the prostitution activities were being conducted at the hotel premises. 5.

The applicant is in custody from 23rd April, 2019. There are no criminal antecedents against the applicant. On completing investigation, charge-sheet is filed. The victim had admitted in their statement that they were voluntarily indulging in prostitution activities.

Considering the aforesaid circumstances, further detention of the applicant is not called for. Hence, case for grant of bail is made out.

Hence, I pass the following order;

O R D E R

i) Bail Application No. 2553 of 2019 is allowed; ii) The applicant is directed to be released on bail in

connection with C.R. No. 724 of 2019 registered with Chakan Police Station, Pune on furnishing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount;

iii) The applicant shall report concerned police station once in a month on every first Saturday between 10.00 am. to 12.00 noon till further order.

iv) Bail Application stands disposed of accordingly. (PRAKASH D. NAIK, J.)
