Not on board. On being mentioned, taken on board. Heard the learned counsel for applicant. None for respondent no.2 / original complainant, though appears to be served. Learned counsel for applicant submits that applicant be directed to furnish one or two sureties instead of one surety to the extent of Rs.20,000/- and has prayed that time of two months be granted to pay interest whatsoever is accrued on amount of Rs.15 Lakh. avk 1/2
PM-2-APPR-573-2016.doc It is also submitted that till applicant furnishes surety, he be released on cash bail of Rs.20,000/- for a period of 3 weeks. Perused the order dated 29th September 2016 of this court vide which applicant while being released on bail is directed to furnish P.R.Bond in the sum of Rs.20,000/- with one surety in like amount, and apart from other directions, is directed to deposit amount of interest accrued on Rs.15 Lakh, within one month.
As it is submitted that applicant since is behind bars, submissions made are accepted and following order is passed : i) Applicant shall be released on his executing P.R.Bond in the sum of Rs.20,000/- with one surety in like amount or two sureties in the sum of Rs.10,000/- each.
ii) Applicant shall be released on provisional cash bail of Rs.20,000/- and shall furnish sureties within three weeks and shall deposit amount of interest as ordered earlier within period of two months from today.
iii)Application is accordingly allowed and disposed of with above stated modifications.
