1] The applicant is apprehending arrest in C.R.No.184/2015 registered with Antop Hill Police Station under sections 409, 420, 120B of the Indian Penal Code. 2] This Court by its order dated 19th October 2015 has granted ad-interim relief to the applicant. The applicant was, thereby, directed to attend Police station and cooperate with the investigation. Learned APP on instructions of Investigating Officer

fairly states that the applicant did attend the police station on the stipulated days and for the stipulated period and did cooperate with the investigation. It is the case of the prosecution that the present applicant introduced the accused No.1 Ramesh Parab with the owner of Jai Metal Company in whose name the original accused No.1 Ramesh Parab drew the cheque from the defalcated amount. Prima facie it appears that the present applicant has not played any other role than introducing Ramesh Parab to the co-accused. In view of the above, custodial interrogation of the applicant is not warranted. The applicant deserves to be granted pre-arrest bail. Hence, following order:- (i) In the event of the arrest the applicant in C.R.No.184 of 2015 registered with Antop Hill Police Station, Mumbai shall be released on bail on his furnishing P.R.Bond of Rs.15,000/- with one surety in the like amount.

(ii) The applicant shall attend the concerned police station on first Monday of every month between 10.00 a.m. and 12.00 noon till filing of charge sheet.

(iii) The applicant shall cooperate with the investigation and

shall not tamper with the evidence or influence the prosecution witnesses.
