Heard learned counsel for the Applicant and APP for the State. This is a subsequent bail application under section 439 of Cr.P.C. The earlier application was rejected by this Court vide order dated 2/2/2017. It is a matter of record that the Applicant herein is arrested on 12/3/2015. 2.
Mr.Tamhankar, learned counsel for the Applicant vehemently submits that the Applicant has been in custody for more than 2 years and till today charge is not framed. It is also submitted that the Applicant has a good case on merits. It is submitted that he is not directly involved in the offence. It is also recorded that the Applicant was approached by the other co-accused. He had sought time to think over. Finally, the Applicant was coerced to agree with the co-accused and therefore on 11/3/2015 he had consented and accordingly a plot was hatched. All these aspects are matters of evidence and therefore at this stage, the Court is not inclined to consider the merits of the matter.

Learned counsel for the Applicant fairly submits that the trial be expedited. It is a fair submission and the learned Special Judge in MCOC Special Case No.14/2015 is hereby requested to make an endeavour to frame charge in the present case not later than 30/12/2017. The learned Judge may further make every endeavour to expedite the trial as far as possible.
