The petition is filed seeking direction to respondent to register offence on the basis of petitioner's complaint dated 23rd July, 2015.

Mrs. Sonavane, learned APP invited our attention to pages 26 and 28 of the petition and submitted that in pursuance of the petitioner's complaint, the petitioner's statement and statement of Mehmood Ali are recorded on 16th August, 2015 and 4th September, 2015. However, she is unable to state what decision the police have taken in respect of the same thereafter. In the circumstances, we direct the Inspector In-charge of Marine Drive Police Station to consider those Shubhada S Kadam 1/2

Sr.No.35 WP 4104.15 statements and take an appropriate decision within a period of seven days from the date of receipt of this order and thereafter communicate the same to the petitioner. The writ petition, accordingly, stands disposed of.

In the event, the police comes to the conclusion that the dispute raised by the petitioner is of civil nature, the petitioner is always at liberty to approach the Magistrate by way of private complaint. 4.

It is made clear that we have not gone into the merits of the matter and all rights and contentions of the respective parties are kept expressly open.
