1. The learned A.P.P. on instructions submitted that, in the present case i.e. in Sessions Case No. 239 of 2016 the prosecution as of today has examined six witnesses and three witnesses including the Medical Officer are yet to be examined.

2. In view thereof, the learned counsel for the applicant on instructions seeks leave to withdraw the present application with liberty to file a fresh application before the trial Court if the trial arising out of the aforesaid sessions case does not conclude within a period of six months from today.
