Heard learned counsel for the Applicants.

The Applicants are apprehending arrest in C.R.No. I-128 of 2017, registered with the Sarkhej Police Station, Ahmedabad, for the alleged offences punishable under Sections 103, 104 r/w 420, 467, 468, 469, 471 & 120B of the Indian Penal Code.

Learned counsel for the Applicants submits that the Applicants had filed an Application, being ABA No.1195 of 2017

seeking transit bail in this Court. He submitted that in view of the statement made by the learned counsel for the intervenor/complainant, that the offences alleged were bailable in nature, this Court (Coram : Prakash D. Naik, J.) disposed of the said Application, vide Order dated 20.07.2017 as then the question of granting transit bail did not arise. Learned counsel for the Applicants submits that after the said order dated 20.07.2017 was passed, the intervenor/complainant moved the Metropolitan Magistrate's Court, pursuant to which, the non bailable sections were added. The Applicants are ladies. 4.

In the peculiar facts of this case, the Application is allowed on the following terms & conditions:-

O R D E R

(i) In the event of the Applicants' arrest in connection with C.R.No. I-128 of 2017, registered with the Sarkhej Police Station, Ahmedabad, the Applicants be enlarged on transit bail, for a period of three weeks from today, on executing P.R.Bond in the sum of Rs.15,000/- each with one or two sureties in the like amount; (ii) During this period, the Applicants shall approach the appropriate Court and seeks necessary orders.

It is made clear, that this Court has not considered the Application on merits.

The Application is accordingly disposed of.
