Heard. This Application is for condonation of 36 days delay in preferring the appeal challenging the judgment and award dated 20.12.2010 passed by the Reference Court in LAR No.260/1999.
Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

a) The Civil Application is allowed in terms of prayer clause (a) which reads thus:
"(a) The delay of 36 days in filing the present appeal against the impugned judgment and award dated 20.12.2010 passed in Land Reference No.260/1999 by the District Court, Nashik be kindly condoned and the Appeal be heard on merits."

Civil application stands disposed off accordingly.

No order as to costs.
