This is an application for bringing legal heirs of the petitioner No.5 on record. It is stated that, the petitioner No.5, i.e. Sou. Mandakini Tanaji Gadakh passed away on 04th June 2017. There is delay of 25 days in filing the present Application.

Learned counsel for the applicants submitted that, in pursuance of Order dated 8th January 2019, she has served the respondents through Speed Post and an Affidavit of service dated 6th February 2019 has been filed stating the said fact. Despite service, none appears for the respondents.

Perusal of the application would indicate that, sufficient cause is made out for condonation of delay and for allowing the application. 1/2

29-caw-27-18.doc In view thereof, delay is condoned, abatement, if any, is set aside and the application is allowed in terms of prayer clauses (b) and (c). 4.

Necessary amendment be carried out within a period of two weeks from today.
