By this petition, the petitioners seek quashing and setting aside of the summons issued to the petitioners under section 91 of the Criminal Procedure Code by Senior Inspector, Dadar Police Station, Mumbai at the instance of Fortune Credit Capital. Direction is also sought that no coercive steps be taken against the petitioners, by the said police.

Vide order dated 14/7/2022 learned counsel for the

rsk 2 20--1---WP-4674-19.doc petitioner had assured that the petitioner No.2 will appear before the Sr. Inspector of Police, Dadar, pursuant to the last summons issued by the police dated 29/6/2022. We, in the said order, have recorded the statement of learned APP on instructions of the Police Officer - Mr. Akrur Uddhavrao Shendge, that presently no coercive action is contemplated as against the petitioner No.2. 3.

Pursuant thereto, the petitioner No.2 attended the concerned police Station on 27/7/2022. Learned APP does not dispute the same. Ld. APP submits that the Petitioner No.2 is now, not required to attend the police station and as such the police will be filing an appropriate report, after considering the complaint and the documents tendered by the respective parties. She further submits on instructions, that no coercive steps are contemplated as against the petitioners. Statement accepted.

In view of the aforesaid, nothing survives for further consideration in the petition. The petition stands disposed of, having regard to the statement made by the learned APP on instructions.
