IN THE HIGH COURT OF JUDICATURE AT BOMBAY CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 3585 OF 2016 Mrs. Roshani Girish Mali.

..Petitioner.

Versus

State of Maharashtra & Another.

..Respondents.

Mr. Ganesh Bhujbal for the Petitioner.

Mrs. A.S. Pai, APP for the State.

Coram : Ranjit More & Dr. Shalini Phansalkar-Joshi, JJ.

Date : November 15, 2016.

P. C. :

1.

Heard learned Counsel appearing for the Petitioner and learned APP for the State. Perused the FIR and statements. In pursuant of the FIR lodged by the Petitioner, investigation was carried out by Nhava Sheva Police Station. Statements of the relevant witnesses have been recorded. Charge-sheet for the commission of the offence punishable under sections 498A, 323, 506, 404, 406 and 504 read with 34 of the Indian Penal Code, 1860 has been filed.

2.

It is not the grievance of the Petitioner that proper sections have not been applied. The grievance of the Petitioner seems to be that statements of the neighbours are not recorded. Statements of the neighbours are not recorded in the light of supplementary statement of the Petitioner herself in which she has stated that she was not allowed to go out of home nor she patilsr 1 / 2

was allowed to talk to any outsider. In these circumstances, we do not find any justification to entertain this writ petition and the same is accordingly dismissed.
