The applicant herein, who is the complainant has sought leave to challenge the judgment dated 05.08.2014 in C.C. No.1507 of 2011, wherein the learned Judicial Magistrate, First Class, Karad has acquitted the respondent no.1 accused under Section 138 of the N.I. Act.

Heard the learned Counsel for the applicant. It is seen that the respondent no.1 accused has been acquitted mainly on the ground that the loan was barred by limitation. Arguable points

are raised. Hence, leave is granted. Appeal is admitted. 3.
