The Development Permission is denied. The learned Counsel for the Petitioner submits that the same is denied under Section 45 of the Maharashtra Regional and Town Planning Act 1966 (for short "MRTP Act").

The Petitioner has remedy of appeal under Section 47 of the MRTP Act. The Petitioner is at liberty to avail the said remedy. In that event all contentions of the parties are kept open.
