After having heard respective Counsel for parties for some time, in my opinion, the following order, which is passed with consent of the parties shall meet the ends of justice.

The statement made by the Respondent - Plaintiff in Regular Civil Suit No. 106 of 2014, that he shall not proceed ahead to the suit till the final decision in Regular Civil Appeal No. 80 of 2013 which is preferred against the decree passed in Regular Civil Suit No. 152 of 2008

2/2 Yadav 6.wp.10985.15 is taken on record in the form of an undertaking, since made on instructions.

As such, the hearing of Regular Civil Suit No. 106 of 2014 shall remain deferred till decision in Regular Civil Appeal No. 80 of 2013 referred supra pending on the file of Additional District Judge, Vaduj, District Satara.

The learned District Judge, Vaduj shall make every endeavour to decide the said Regular Civil Appeal No. 80 of 2013, in which I am informed that pleadings are complete within a period of four months from the date of production of this order.

The parties agree that they shall co-operate the appellate court in expeditious disposal of the Appeal.
