IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL CONTEMPT PETITION NO.6 of 2016 A to Z Industrial Premises Co-operative Society Ltd .... Petitioner.

V/s.

M/s APHALI Pharmaceuticals Ltd & Ors .... Respondents. None for the Petitioner.

Dr. F.R.Shaikh, A. P.P. for Respondent No. 3. Mr. Indrajeet V. Suryawanshi i/by Thodur Law Assoc. for Respondent Nos. 1 and 2.

CORAM : A.S. OKA & ANUJA PRABHUDESAI, JJ.

DATE : 23 rd JANUARY, 2017 P.C. :

None appears for the petitioner. Criminal Contempt is filed on the ground that the first and second respondents have interfered and obstructed the administration of justice in relation to the proceedings before Deputy Registrar of Co-operative Societies appointed under the Maharashtra Co-operative Societies Act, 1960. The Deputy Registrar is not a Court within the meaning of Contempt of Courts Act, 1971. Only on this ground, we decline to entertain this petition. We, however, make it clear that we have not made any adjudication on merits and all contentions of the parties are kept open.
