We are not in agreement with the submission of the learned counsel for the Petitioners that permission could not have been sought by the Investigating Agency to investigate into a non-cognizable offence, after the registration of an FIR.

We are informed by the learned APP that pursuant to the permission which was granted investigation was completed and a charge-
