CORAM:
R.D.DHANUKA & ABHAY AHUJA, JJ.
DATED :
DECEMBER 1, 2021 P.C.
The learned counsel for the Petitioners seeks liberty to withdraw these Writ Petitions with liberty to file fresh petition and to impugn subsequent orders passed during pendency of these petitions.
The Petitioners have already filed Civil Application No.2668/2018 for amendment in the Writ Petition. The said Civil Application remained pending before this Court for about 3 years.
In these circumstances, the learned counsel for the Petitioners seeks liberty to withdraw these petitions with liberty to file fresh substantive petitions incorporating the subsequent events and the orders passed by the Authority. We are inclined to accept the prayer of the Petitioners for granting liberty to withdraw these Writ Petitions with liberty to file fresh petition.
We, accordingly, pass the following order:
a.
All these Writ Petitions stand disposed of as withdrawn with liberty to file fresh petition. 2/3
b.
In view of disposal of the Writ Petitions as withdrawn with liberty to file fresh petitions, the pending Civil Applications do not survive and accordingly disposed of.
c.
It is made clear that this Court has not expressed any view on the merits of the matter. d.
All contentions of the parties are kept open. (ABHAY AHUJA, J.) (R.D.DHANUKA, J.) 3/3
