Heard parties through their counsel. The grievance of the Petitioner is that his proposal for appointment as Assistant Teacher is pending since 4th December 2012 and without deciding the same, another Teacher has been posted in place of the Petitioner vide order dated 14th September 2016 (Exh.'K' to the Petition). According to the Petitioner, unless the proposal sent by the Institution for its approval is decided, the post cannot be declared surplus and nobody can be posted at his place.

Having considered the submissions made by the learned counsel for the parties, we are inclined to dispose of the Petition by directing the Respondent No.3 to consider and take appropriate decision on the pending proposal (Exh.'K') as expeditiously as possible and not later than one month from the date of receipt of copy of this order. In the meanwhile, status-quo as it exists today shall be maintained by the parties till the decision is taken by the Respondent No.3 on the pending proposal.

The Petition stands disposed of.
