Heard Mr. Yakshay Chheda, learned counsel for the petitioner and Mr. V.V. Gangurde, learned APP for the State. 2.

The petitioner herein had filed a Complaint Case No.4406939/SS/2015 before the Ld. Metropolitan Magistrate, 44th Court, Andheri, Mumbai under Section 138 of Negotiable Instruments Act which has been dismissed for non payment of court fees. 3.

Considering the grounds set out at page 7 of the petition, particularly ground (E), the petition is allowed. Impugned order dated 17th October, 2016 is set aside. Complaint Case No.4406939/SS/2015 stands restored to file. Petitioner is directed to pay the court fees within two weeks from today by way of last opportunity. (SMT. ANUJA PRABHUDESSAI, J.)
