1] The Applicant who is also referred to as 'Billa' in the complaint lodged on 12.08.2022 with Shivaji Nagar Police Station, is apprehending his arrest on facing accusation under Sections 307, 324, 504, 506(2) red with 34 of the Indian Penal Code. 2] On perusing the copy of the complaint, where a limited role has been ascribed to the Applicant to the effect of abusing Kalam and holding his collar, the learned APP was asked to produce on record injury certificate of Kalam. However, he states that that there is no such injury certificate. As such, there is no such prima facie evidence leading to inference that Kalam sustained any injury. 1/2

(17)ABA-2829-2022.doc 3] In the wake of aforesaid circumstances, emerging on record, custodial interrogation of the Applicant is not necessary. Hence, the following order is passed :

O R D E R

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.845/2022 registered with Shivaji Nagar Police Station, the applicant Asgar Ali Ahmed Qureshi shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount. (c) The applicant shall report to the Investigating Officer on 20.10.2022 and 21.10.2022 between 3.00 p.m. to 5.00 p.m., and thereafter, as and when called for. (d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
