In view of transfer and posting of the officer concerned, against whom the grievance has been raised in the Petition, no cause survives to proceed with the Petition. Parties are directed to appear before the SubDivisional Officer, Igatpuri-Trimbakeshwar, District Nashik on 11.03.2019. On appearance of the parties, the Sub-Divisional Officer, IgatpuriTrimbakeshwar is directed to fix date for hearing of Tenancy Appeal No. 16/2009 pending before him after giving an opportunity of hearing to all concerned decide the Appeal on its own merit within six months from the date of appearance of the parties.

It is made clear that this Court has not examined merit of the case and the authority concerned shall decide the appeal on its own merit. 3.

Petition is disposed of in above terms with no order as to costs. 4.
