This petition takes an exception to the order dated 6.6.2017 passed by the learned Civil Judge, Senior Division, Nashik below Exhibit-37 in Regular Civil Suit No. 715 of 2015 and the order dated 9.8.2017 passed by the learned District Judge-9, Nashik in Civil Miscellaneous Appeal No. 85 of 2016.

On instructions, the learned counsel for the petitioners states that the petitioners do not intend to press the present petition. However, he prayed that directions may be given to the learned trial court to decide the suit expeditiously. 3.

Considering the facts and circumstances of the present case and as the interim injunction is operating against the present Dinesh S. Sherla 1/2

2/2 6-cwp-12612-17.doc petitioners, the learned trial court shall endeavour to decide Regular Civil Suit No. 715 of 2015, as expeditiously as possible and in any case within a period of one year from the date of receipt of copy of this order.

The learned trial court shall decide Regular Civil Suit No.715 of 2015, on its own merits, without being infuenced by the order passed by the appellate court in Civil Miscellaneous Appeal No. 85 of 2016.

With aforesaid directions, Writ Petition is disposed of as not pressed.
