Ms. Niky Mody, Advocate appears for the original complainant and submits that she has instructions to oppose the present application. She vehemently opposed the application and submitted that the complainant wants to recover the property from the applicant at the instance of the police.

A bear reading of the first information report prima facie shows that the facts narrated by the complainant is an exaggerated version made in the complaint.

2) The learned APP on instructions submitted that in pursuance of order dated 30.10.2015 the applicant has attended the police station and co-operated in the process of investigation. The learned APP on instructions further submitted that the custodial interrogation of the applicant is not necessary.

4) In view of the above, the interim relief granted on 30.10.2015 is hereby confirmed. Application is allowed in the aforesaid terms.
