Heard learned counsel for the parties.

By an order dated 9 December 2021 this Court, while granting interim protection from arrest to the Applicant, had recorded statement on behalf of the Applicant, that the Applicant N.S. Kamble page 1 of 3
is ready to deposit the entire amount of Rs.2,82,952/- which is subject matter of the FIR.

The learned counsel has today produced a copy of the receipt dated 20 December 2021 showing that the said amount is deposited before the learned Magistrate at Pune. 4.
The learned counsel for the intervenor seeks leave to withdraw the amount. The learned counsel for the Applicant has no objection for such withdrawal, without prejudice to the rival contentions of the parties.

In such circumstances, the following order is passed.
ORDER
(i) In the event of his arrest in connection with investigation of Crime No.580 of 2021 registered with Bharathi Vidhyapith, Pune City, the applicantSachin Ankush Chavan shall be released on bail on executing a P.R. Bond in the sum of Rs.25,000/-with one or two solvent sureties in the like amount. (ii) The applicant shall co-operate with the Investigating Agency and shall report to the Investigating Officer as and when required.

(iii) The amount deposited before the learned Magistrate, Pune is permitted to be withdrawn by the complainant Shri.Adhinath Asaram Shelar. This shall be without prejudice to the rival contentions of the parties.
(iv) The Criminal Application is disposed of in the aforesaid terms.
(v) The Interim Application is also disposed of.
