This Application is moved by the original complainant for release of amount of Rs.42,00,000/- deposited by the accused before the trial Court as per section 148 of Negotiable Instrument Act.

The learned counsel Mr. Mundargi for the applicant/accused submitted that he has no objection to release the said amount in

5.APPR471_2018.doc favour of the complainant in view of proviso of sub-section (3) of Section 148 of Negotiable Instrument Act.

The amount of Rs.42,00,000/- along with interest, if any accrued therein, is released in favour of the complainant on condition to comply with the relevant provisions of sub-section (3) of Section 148 of Negotiable Instruments Act. 4.

Registrar of trial Court to take note of it and see that it is complied with.

Criminal Application is disposed of.
