Heard. This application is for bringing legal heirs on record of deceased Respondent No.1. Madhukar A.

Chandrachud. He submits that the legal heirs of deceased Respondent No.1 are already on record. She submits that she may be permitted to carry out appropriate amendment in the cause title by showing Respondent Nos.2 and 3 as legal heirs of deceased Respondent No.1.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Basavraj G. Patil 1/2

12.2084.18-caf.odt Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a.

The Civil Application is allowed in terms of prayer clause (a) which reads thus:

"(a) The Appellants herein be allowed to amend this appeal and pending Civil Applications as per the Schedule of Amendment Exhibit-I annexed hereto."

b.

Amendment to be carried out on or before 31.08.2019 failing which the Civil Application shall stand dismissed without further reference to the court.

c.

If amendment is carried out within stipulated time as stated hereinabove, the Applicant is directed to serve an amended copy of the First Appeal, on the Advocate for the Respondents, immediately thereafter.

d.

Civil application stands disposed off accordingly.
