DATE : 27th JULY, 2023 P.C:- Consent terms dated 27th July, 2023 are being tendered across the bar by the learned counsel for the appellant as well as respondent nos. 1 and 2 submitting that the matter is settled between them. 2.

The appellant insurance company has already deposited the entire decretal amount in M.A.C.T., Pune. Out of the said amount that is deposited by the respondent nos. 1 and 2 who have also signed the consent terms and are present in Court and have waived the amount of Rs.2,50,000/- which will be withdrawn by the insurance company. The balance amount would be withdrawn by the respondent nos. 1 and 2.

The said consent terms are taken on record and marked 'X' for the purposes of identification. The undertakings contained in the consent terms are accepted as an undertakings to this Court.

The First Appeal stands disposed in terms of the consent terms. 4.

In view of the disposal of the appeal pursuant to the consent terms, the statutory deposit along with interest lying in this Court be transferred to the M.A.C.T., Pune.
