Learned counsel for the applicants states that the respondents are served. He undertakes to file affidavit of service within one week from today.

Learned AGP on behalf of the respondent no.4 is present. The respondent no.5 is a formal party. The respondent nos.1 and 2 are absent though served.

By this civil application, the applicants seek condonation of delay of 143 days in filing the present civil application for bringing the legal heirs of deceased petitioner on record and for setting aside the order for abatement, if any. No affidavit-in-reply is filed.

For the reasons recorded in the civil application, civil application is made absolute in terms of prayer clauses (a), (b) and (c). Amendment to be carried out within two weeks from today. Amended copy of the writ petition shall be served upon the respondent nos.1, 2 and 4 within two weeks from the date of carrying out such amendment. 5.

Civil application is disposed of in aforesaid terms. No order as to costs.
