The above Civil Application has been filed for interim stay to the award passed by the Reference Court i.e. the Court of the Learned additional Judge Pune. The state has deposited the decreetal amount in the Reference Court and an order has also been passed by this Court permitting the Claimants to withdraw the amount to the extent mentioned in the said order. In my view, since the State has already deposited the amount, the above Civil Application would have to be allowed and is accordingly allowed in terms of prayer clause (b). However the same would have no effect on the order of withdrawal passed by this Court in the application filed by the Claimants.
