Heard the learned counsel for the petitioner. By this petition, the petitioner is challenging the show cause notice dated 28.8.2019 issued by respondent No.2. It is not disputed that if any action is to be taken against the petitioner, that will be only after giving him an opportunity of being heard.

In that view of the matter, we are of the view that the petition is premature and, therefore, we are not inclined to entertain the same. Writ Petition is accordingly dismissed.

919wp10669.doc However, we direct that in the event any order is passed against the petitioner under section 78A(1)(b) of the Maharashtra Cooperative Societies Act, disqualifying him, the said order shall not be given effect for a period of two weeks from the date of communication thereof to the petitioner.

It is specifically made clear that this Court has not gone into merits of the matter and all points and contentions of the respective parties are expressly kept open.
