The Applicant, apprehending arrest, in connection with the investigation of Crime No. 480 of 2021 registered with Khed Police Station, under Section 406, 408, 409 and 420 read with Section 34 Indian Penal Code is seeking anticipatory bail. 2.

The aforesaid offence is registered on the basis of the complaint dated 21 October 2021 lodged by Sharad Sahebrao Bhand who is a Development Officer (Gram Panchayat). According to the first informant there were irregularities/misappropriation in the development work under the XIV Finance Commission for the year 2018-2019 to the extent of Rs.8 Lakhs and odd.

I have heard the learned counsel for the parties. 4.

This Court on 9 December 2021 had recorded statement on behalf of the Applicant who is Gram Sevak, that he is ready to deposit an amount of Rs.8,24,730/- in the Trial Court within four weeks and in that view of the statement, this Court had directed that the Applicant may not be arrested. 5.

The learned counsel for the Applicant today has submitted that the amount is deposited on 6 January 2022. A copy of the receipt is produced which is taken on record and marked 'X' for identification.

The learned Additional Public Prosecutor submitted that the Applicant has reported to the Investigating Officer and co-operated with the Investigating Agency.

In that view of the matter, the following order is passed.

ORDER

(i) In the event of his arrest in connection with investigation of Crime No. 480 of 2021 registered with Khed Police Station, the applicant shall be released on bail on executing a P.R. Bond in the sum N.S. Kamble page 2 of 3

of Rs.25,000/-with one or two solvent sureties in the like amount.

(ii) The Applicant shall report to the Investigating Officer on 24 and 25 February 2022 between 11.00 a.m. to 1.00 p.m. and shall produce all the necessary records/documents as may be required by the Investigating Officer and shall co-operate with the Investigating Agency.

(iii) The Applicant shall not tamper with the prosecution evidence/witnesses.

(iv) The Criminal Application is disposed of in the aforesaid terms.
