Heard Mr. Borade, learned counsel for the Applicant and Ms. Mhatre, learned APP for the State. Perused record of Investigation. 2.

The record of investigation reveals that, an amount of Rs.2,00,000/- was transferred by Mr. Khichdu Yadav (Accused No.1) in the account of Applicant towards his remuneration / alleged profit. By a speaking Order dated 3rd October 2019, the Applicant was granted interim relief and was directed to deposit Rs.2,00,000/- in the Registry of this Court on or before 15th November 2021. The Applicant has accordingly deposited the said amount of Rs.2,00,000/- in the Registry of this Court on 13th November 2019. The note put-up by the Registry endorses the same.

Tauseef 24-ABA.2010.2019.doc Learned APP, on instructions, submitted that, the Applicant has complied with the directions issued by Order dated 3rd October 2019, and has cooperated in the process of investigation. 3.

The Investigating Agency is seeking custody of the Applicant only for the purpose of recovery of the said amount Rs.2,00,000/-, which was received by him from Mr. Khichdu Yadav (Accused No.1). As Applicant has now deposited the said amount in the Registry of this Court to show his bonafide, his custodial interrogation for further investigation of the present crime is not necessary.

In view of the above, interim relief granted by Order dated 3rd October 2019, is hereby confirmed. However, the condition to attend the Investigating Officer is waived.
