Heard Mr. Chavan, learned Counsel for the petitioner and Mr. Kathane, learned Counsel for respondent No.1. Learned Counsel for the petitioner states that daughter-in-law of the petitioner is present in the Court. He has tendered photo copy of PAN card of daughter-in-law of the petitioner which is taken on record and marked as Article-X for identification. Upon taking instructions from her, he states that the Petitioner does not wish to proceed with the matter. He seeks permission to withdraw the Petition.

Learned Counsel for Respondent No.1 submits that he has no objection for withdrawal of the Petition. He submits that Respondent No.1 may be permitted to withdraw the amount deposited by the Petitioner in this Court. Learned Counsel for the petitioner has no objection to withdraw the amount deposited by the petitioner in this Court.

In view thereof, on the motion made by Mr. Chavan, the Petition is allowed to be withdrawn and disposed of as such. Respondent No.1 is permitted to withdraw the amount deposited by the petitioner in this Court unconditionally. Order accordingly. [R.G. KETKAR, J.]
