Learned Counsel for the petitioner states that the petitioner has made code to the deficiencies on account of which recognition to his institute was cancelled. He says that he will make a representation to the respondent giving details of the manner in which such deficiencies have been removed. The learned Counsel further states that the institute will now operate beyond 1 km from the existing institute. If the petitioner make representation to the aforesaid effect, the respondents are directed to consider the same in accordance with law and on its own merits as expeditiously as possible and in any case within two weeks from the date the petitioner makes such representation.

The aforesaid directions have expeditious consideration is issued because the learned Counsel points out that the admissions to the institute are required to be completed in the month of December. It is made clear that this Court has not examining the merits of the matter and, therefore, it is for the respondent to take appropriate decision in accordance with law and on its own merit upon the representation of the petitioner.

The learned AGP points out that the respondents are competent to consider such representation. Accordingly the direction for expeditious disposal is issued to the Deputy Director of Education, Mumbai. 3.

The Writ Petition is disposed of accordingly. 4.
