The learned Senior Counsel appearing on behalf of the Petitioner Shri Janak Dwarkadas, on instructions, seeks withdrawal of the above Writ Petition to file an Appeal under Section 7-I of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952. The above Writ Petition is accordingly allowed to be withdrawn. If the issue of limitation arises the fact that the Petitioner was prosecuting the instant Petition in this Court can be urged on behalf of the Petitioner. Since the learned Senior Counsel for the Petitioner states that the Appeal would be filed within a period of two weeks from date, the matter not to be precipitated with on the basis of the impugned order for a period of two weeks from date.
