This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No.302 of 2021 registered at Nigadi Police Station, Pune for the ofences punishable under Sections 489-A, 489-B, 489-C and 489-D read with 34 of the Indian Penal Code.

On the basis of secrete information, on 23 June 2021, a trap was laid and in the said trap, the present applicant and other coaccused were found in possession of counterfeit currency notes. 4.
I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

The learned counsel for the applicant submits that considering the material on record at the most Section 489-C of Dinesh S. Sherla 1/2
915-ba-3114-22.doc the IPC would attract and for which the punishment is only 7 years. It is submitted that the applicant is in jail for more than 1 and 1⁄2 years. It is further submitted that there are no other criminal antecedents. It is thus, submitted that the applicant may be released on bail.

On the other hand, the learned APP appearing for the State submits that huge quantity of counterfeit currency notes of Rs.5,86,000/- were found in possession of the applicant. It is submitted that considering the nature of ofence, the applicant may not be released on bail.

Considering the fact that the applicant was found in possession of huge quantity of counterfeit currency notes of Rs.5,86,000/-, I am not inclined to release the applicant on bail. Hence, the Bail Application is rejected.
