1] Heard learned counsel for the respective parties. 2] The petition is filed for quashing and setting aside the F.I.R. bearing No.I-467 of 2016 registered with Valiv Police Station, Vasai, District: Palghar, for the offence punishable under Sections 342, 343, 363, 395, 397, 323, 504, 506 of the Indian Penal Code. 3] Dr. Shaikh, learned APP, on instructions makes a statement that the F.I.R. was investigated and after due investigation "B" summery report is filed. In support of his submission, he placed on record the report dated 20.11.2017, given by Senior Inspector of 1/2
85 APL 1226 OF 2016.odt Police, Valiv Police Station. The report is taken on record and marked "X" for identification.
4] In the light of above, the grievance of the petitioner at this stage no more survives. The petition is disposed off accordingly. 5] Respondent No.2 original complainant is at liberty to file protest petition against the same "B" summery and if such petition is filed, learned Magistrate shall decide the same after hearing respondent No.2.
