By an Order dated 10.10.2017, the Applicants were granted interim relief.

It is the prosecution case that accused No.1 Satyendra Karandikar alongwith present Applicants accepted a sum of Rs.19,78,833/- from the first informant Smt. Arju Alamin Lokhandwala

towards sale of a motor bike namely Bajaj Kawasaki. That despite lapse of substantial period, the accused persons neither gave delivery of the said bike nor refunded the amount accepted by them. In the premise, the first information report is lodged.

The record indicates that the Applicant Geetanjali was the wife of accused No.1 Satyendra Karandikar. That due to matrimonial discord between the parties, a divorce Petition was filed on 16.12.2016 before the Family Court at Pune which has been decreed on 01.07.2017 and the marriage between accused No.1 Satyendra and the Applicant Geetanjali has been dissolved.

As far as Sharadchandra N. Karandikar is concerned, he is father of accused No. 1 Satyendra and is aged about 77 years. It appears from the record that the Applicants herein were sleeping partners of the firm namely M/s. SNK Bajaj, Pune and were not involved in the day to day affairs of the business of the said firm. The record clearly indicates that it is the accused No.1 Satyendra Karandikar who was conducting the day to day affairs of the said firm and was looking after the business. The record further indicates that accused No.1 Satyendra has been arrested by the police. The necessary documents have been seized at his instance and as of today, he is in judicial custody. It further appears that accused No.1 Satyendra has played a vital role in the present crime.

In view of the above, the Applicants can be protected by way of pre-arrest bail.

Interim Order dated 10.10.2017 is hereby confirmed. 7.
