Civil Application No.2011 of 2015 is for enforcement of a decree of maintenance. On the last occasion, learned Counsel for the Applicant was directed to furnish a chart showing upto date arrears of maintenance. Learned Counsel for the Applicant has, accordingly, submitted a statement showing the total outstanding arrears of maintenance as of date of

Chittewan 2/2 3 CAS 2011-15.doc Rs.3,34,000/-. The statement is not disputed by learned Counsel for Respondent No.1. Learned Counsel for Respondent No.1 (original Defendant No.1) also undertakes, on specific instructions, to make payment of Rs.25,000/- in the course of the day. Learned Counsel for Respondent No.1, on instructions from her client, who is present in Court, undertakes to the Court that Respondent No.1 shall clear the balance outstanding arrears claimed by the Applicant within three months from today. On this express undertaking, which is accepted by the Court, the civil application is stood over to 9 June 2017. In view of the order passed today, companion Civil Application No.1712 of 2015 does not survive and the same is disposed of. (S.C. GUPTE, J.)
