When this court declined to entertain the present Writ Petition, advocate for the Petitioner seeks permission to withdraw the present Writ Petition with liberty to file a fresh Suit. To that effect, he has given in writing. Same is taken on record and marked "X" for its identification. Same is accepted. Writ Petition stands disposed of as withdrawn with liberty to file a fresh Suit. That Suit should be decided by the Trial Court on its own merits on all issues, including limitation issue, if any. No order as to costs.
